09:36 - Autor: pipinDie israelische Webseite NGOHQ.com ist von NVIDIA wegen Verbreitung modifizierter Treiber und daraus resultierenden Verstößen gegen Section 106 des Copyright Act aufgefordert worden die Verbreitung des Treibers binnen zwei Wochen einzustellen.
NVIDIA beruft sich dabei auf das geistige Eigentum an den Treibern und einer NGOHQ.com nicht vorliegenden Genehmigung zur Verbreitung der Treiber, die dem Copyright unterliegen. In Santa Clara weist man daraufhin, dass die modifizierten Treiber, die vor allem auch ältere Grafikchips unterstützen, ein Risiko für die Stabilität darstellen würden.
"NVIDIA drivers that are distributed through authorized channels have been tested on the supported platforms that are included in the driver INF file, and are supported by NVIDIA and its OEM partners. Modifying drivers to add products that were not intended to be supported in the driver may cause more problems for customers due to limited testing and known problems on some products."
NGOHQ.com bietet diese Treiber, wie einige andere Webseiten auch, an und scheint allerdings nicht im Mindesten beeindruckt von den möglichen Rechtsfolgen. Auf Grund der Tatsache, dass NGOHQ.com eine israelische Seit ist, verneint man die Geltung des amerikanischen Copyright Acts und droht NVIDIA dagegen unverhohlen mit Gegenklagen."NGOHQ.com hasn’t violated any local law, the only ones who did violate, is NVIDIA with their continued abuse, harassment and attempts to drive NGOHQ.com out of business illegally. We will not remove the software; it is fully legally with our local law, while NVIDIA is violating the United States Antitrust Laws & Huk Hahegbliim Haiskiim Haisraeli by preventing us from running. If NVIDIA will continue abusing, harassing and illegally forcing their OEMs not to work with us, we will have no choice but to take legal actions against NVIDIA for Antitrust and Discrimination Violations."
Die Seite wirft NVIDIA damit Verstöße gegen das Antitrust-Gesetz vor und führt zusätzlich zu dem Vorgehen gegen NGOHQ.com folgende Punkte an:
* Possible use of illegal blackmail tactics against the press.
* Possible use of illegal The Way It's Meant To Be Played program to gain unfair advantage and abuse the open market.
* Possible use of illegal false advertisement.
* Possible use of illegal viral marketing campaigns.
* Possible use of software support being used as tool to promote sales illegally.
